Rules of the contest for the name of the online version of the esc textbook of cardiovascular medecine 3rd edition

3 x 1-year ESC Professional memberships and one x 2-year ESC Professional membership



Article 1. Organization

The "Organizing Company" EUROPEAN SOCIETY OF CARDIOLOGY (ESC), 29/04/1992, whose registered office is at the following address: European Heart House, 2035 Route des Colles - The Templars - CS80179 Biot, 06903 SOPHIA Antipolis Cedex France represented by its Chief Executive Officer (CEO) Isabel BARDINET, organizes from 26 July to 30 July 2017, a competition ("game") free of charge and with no purchase necessary:

"3 free ESC Professional memberships and a print textbook offered" ("prizes")

This game is available on social networks: Facebook and Twitter, 

All trademarks, logos and other distinctive signs reproduced on these networks are the exclusive property of the European Society of Cardiology and are protected as such by the provisions of the French Intellectual Property Code.

Any unauthorised reproduction of these trademarks, logos and signs constitutes an infringement punishable by criminal sanctions.

This document (“Regulation”) establishes the legal rules applicable to this game. 

Article 2. Participation

This game is for Cardiologists and Allied Healthcare Professionals, holding a MyESC account.

Creating a MyESC account is free on the website escardio.org. Excluded is any employee of the Organizing Company and, in general, any person involved in the organization of this game.

Participation is individual, and is done by providing one or more names for the described product. The terms "like" and comments on another participant’s proposal are encouraged, but do not constitute a participation in the game/contest.

Reading and acceptance of these rules is mandatory for all participants.

In any event, by participating in this game, the participant must strictly comply with conditions as defined, as well as any other instructions that would be provided by any other means to him.

Proposals retained and potentially winning proposals will be automatically communicated on social networks, and people informed by email.

Any proposal made by several participants will be awarded to the participant who made it first based on date and time of submission.

Article 3. Duration and principle

Participants must comment in the contest section provided for this purpose by providing a title for the online product based on the ESC Textbook of Cardiovascular Medicine 3rd edition; they may also briefly justify their proposal. No other form of entry will be accepted.

The game will be open from Wednesday, July 26 to Sunday, July 30 at midnight.

A first selection will be made in view of the availability of names proposed in the public domain (brand and web domain) and the number of "likes" received by each potential proposal. The list shall then be submitted to an ESC selection committee under the control of SCP Rémi CHAVAUDRET & Renaud CASTALAN, Associated Bailiffs at 33 gallerie Vero Dodat, 75001 PARIS.

The selection committee will choose the successful proposals, which will then be submitted to the Management Group of the ESC.

If no name is retained after the above steps from the list of those proposed by the participants, no prize will be awarded.

The participants authorise the Organizing Company to publish their names on the Internet and communication materials promoting the textbook.

Participants authorize the Organizing Company to use their full name, photo, and an indication of their city and country of residence in any promotional demonstration, online services of the Organizing Company and / or those of its partners and any online service or affiliate support, without such authorization providing the right to additional remuneration other than the prizes earned.

Participants assign their rights to product names submitted for this game to the ESC, that is to say that the intellectual property vests in the ESC and may be used by the ESC to designate one or more of their products, without further consideration to the participant.

The Organizing Company of the Game will contact the winners via email to determine the different shipping methods of the prizes.

Any prizes unclaimed within a period of 2 weeks after the date of announcement of the results will be considered abandoned by the winner and no substitute will replace him.

 

Article 4. Prices

  • The authors of the proposals selected in number 3, will receive a membership (ESC Professional Membership) free for the year 2018.
  • The successful final title will entitle the author to a 2nd-year free membership in 2019 and a free print version of the ESC Textbook of Cardiovascular Medicine 3rd edition (when it is available during 2018).

The prizes provided are strictly personal and cannot be transferred to another person.

In the event that the winner would not, or could not, for whatever reason, receive all or part of the prize won under the conditions described in these rules, they lose the full benefit of that provision and may not claim any compensation or consideration. Prizes will not be reattributed and the Organizing Company may dispose of them freely.

Any prizes not claimed as part of this operation will not be reattributed. The winner who has not claimed their prize by the deadline will be considered to have renounced them.

Winners of the Game authorise any checks concerning their identity and domiciliation. Any indication of false identity or false address will result in their elimination. Similarly, the Organizing Company reserves the right to pursue by any means, any attempt to bypass this Regulation, particularly in the case of incorrect information.

Any additional information and any practical details related to awards will be given in due time to the winners.

The prizes may not give rise, on the part of the winners, to any dispute of any kind or to submit their value against any form whatsoever, nor to their replacement or exchange for any reason whatsoever.

In a case of force majeure or if circumstances require, the Organizing Company reserves the right to substitute the prize won with a prize of equivalent or greater value.

Without prejudice to any legal action and their right to cancel the registration of the participant, the Organizing Company is not obliged to send any prize to the beneficiary participant if they have not correctly entered their coordinates at registration; if clearly and, by any means, managed to distort the outcome of a game; or has not complied with this regulation.

The Organizing Company shall not be held liable for a delay in shipment of prizes when this delay is not attributable to them but is attributable to the shipping service provider.

The Organizing Company cannot incur any contractual or legal responsibility in respect of operations relating to transportation or communication of the awarded prizes.

Article 5. Multiple participation per person

Each participant may enter multiple times throughout the game in the period specified in Article 1 (same name, same name, and same email address).

Each person wishing to play must comply with the instructions given to him on the ESC Facebook and Twitter accounts.

A participant, who participates with multiple e-mail addresses, will be disqualified and cannot claim any prize that may have been assigned to them.

The Promoter cannot be held responsible in the case of misdirected email.

There will be one prize per household; the household is determined by all the people living under the same roof.

The Promoter accepts multiple entries per person.

Article 6. Advertising (information) winners

Winners will be notified by email.

Their names will be published on ESC social networks.

Article 7. Information - Gathering data protection act

The information provided by the entrant may be processed and held within the ESC database.

The participant may request to be omitted or to be removed from the file at any time; they will have a right of access, rectification and deletion of data on simple request to the following email address: usercontact@escardio.org accordance with the Data Protection Act of January 6, 1978.

It is reminded that in accordance with the Act, the participant benefits from the right to access and correct their data held by the Organizing Company.

ARTICLE 8. Liability / Force majeure / Extension / Appendices

The responsibility of the Organizing Company is limited to a maximum aggregate amount of prizes involved.

The Organizing Company cannot be held liable for harm of any type (personal, physical, material, financial or otherwise) arising in connection with the participation of a participant in the Game.

It is specified that the Organizing Company of the Game cannot be held responsible for any direct or indirect damage resulting from an interruption, any malfunction, suspension or termination of the Game, for whatever reason.

The responsibility of the Organizing Company shall not be engaged if, for force majeure or independent of their will, this game should be modified, shortened or cancelled.

The Organizing Company reserves, in any case, the possibility to extend the period of participation.

Additions, or in cases of force majeure, changes to these rules may occur during the Game.

Participants agree not to dispute the admissibility, validity or evidential value of the natural elements or format or computer or electronic media mentioned above, on the basis of any legal provision whatsoever that specifies that certain documents must be written or signed by the parties to constitute proof.

Thus, the considered elements constitute proof and, if produced as evidence by the Organizing Company in any litigation or other, they will be admissible, valid and enforceable between the parties in the same way, under the same conditions and with the same value as any document created, received or kept in writing.

Finally, it is expressly agreed that the applicable law is French law.

The Organizing Company reserves the right to exclude from participation in this Competition anyone disturbing the course of the Game.

The Organizing Company reserves the right to use any recourse in particular to prosecute anyone having cheated, deceived, faked or disturbed the operations described in this Regulation, or would have tried to do so.

All participants in the Game considered by the Organizing Company as having disturbed the Game in any of the above ways will be rightfully denied all rights to obtain any winning prize and, because of this fact, no claims will be accepted.

The Organizing Company reserves the right, particularly in cases of compelling reasons or force majeure, to shorten, modify, extend or cancel this competition and/or session of the Game, in part or in whole, if the circumstances require. Thereby, its responsibility cannot be engaged.

Such changes may, however, be subject to prior communication by all appropriate means, including via the website of the Organizing Company.

This game will be cancelled in case of absolute necessity, without the participants or winners being entitled to claim any compensation in this respect.

Article 9. Complaints

Any dispute or claim to this game will not be taken into account unless sent before 7 August 2017, the postmark (or electronic equivalent) will authenticate the time and date of sending.

Any dispute or claim must be made by letter addressed to the Promoter as identified in Article 1.

This letter will indicate the precise date of participation in the game, complete contact information of the participant and the exact reason for the dispute. No other method of dispute or complaint will be taken into account.

The Organizing Company is sovereign in deciding questions of application or interpretation of the Regulation or in the case of deficiency as to the conduct of this Game.

Article 10. Acceptance of the rules

Participation in the Game implies full acceptance of these Rules.

Any practical difficulties of interpretation or application of this Regulation shall be decided solely by the Organizing Company.

The Organizing Company will respond to any telephone or written request concerning the interpretation or application of this Regulation, mechanisms or terms of the Game as well as the designation of the winner.

The Game rules are filed in the offices of CPC Rémi CHAVAUDRET & Renaud CASTALAN, Associate Bailiffs, whose address is as follows: 33 gallerie Vero Dodat, 75001 PARIS.

 

Article 11. Obtaining these regulations

These regulations can be obtained free of charge upon request from the European Society of Cardiology domiciled in the European Heart House - 2035 Route des Colles - The Templars - CS 80179 Biot - 06903 SOPHIA ANTIPOLIS Cedex France.

Article 12. Applicable law

The Rules of the game and its interpretation are subject to the jurisdiction of the French courts and governed by French law.
