Terms and Conditions for participation in “ACVC 10 years anniversary competition” during the month of March 2022



Article 1. ORGANISATION

The "Organising Company" hereinafter The EUROPEAN SOCIETY OF CARDIOLOGY (ESC), registered at the following address: Maison Européenne du Cœur, 2035 Route des Colles – Les Templiers – CS80179 Biot, 06903 SOPHIA ANTIPOLIS Cedex France represented by its Managing Director (CEO) BARDINET Isabel, is organising from March 1st until March 31st 2022, a prize competition (hereinafter the “Competition”) for all Healthcare professionals who are not paying members of the Association for Acute CardioVascular Care (“ACVC”). The Competition will be available from the ESC website and ESC communication channels (e-campaigns). The Competition is called:

ACVC 10 years anniversary Competition”

Below are the Terms and Conditions applicable to this Competition.

Article 2. PARTICIPATION 

Participation in the Competition is open to all Healthcare professionals who are not ACVC paying members and have not been an ACVC paying member in the year 2021. Employees and staff of the Organising Company are not eligible to participate in the Competition nor win prizes.

Participants confirm that any data provided as part of his/her participation is accurate. Any misrepresentation or incorrect and / or incomplete declaration automatically results in the cancellation of his/her participation.

Article 3. DURATION AND PRINCIPLE

The Competition opens on Monday 28th February at 00:00 CET and closes on Thursday 31st March at 00:00 CET.    

The competition is accessible from the ESC website and/or of its promotion via ESC communication channels (e-campaigns) when purchasing an ACVC paying membership via a MYESC account.

When the competition closes, the first ten new ACVC paying members who subscribed before the 31 March 2022 will be the winners of the Competition (hereinafter the “Winner”) and will each receive a prize, as defined in Article 4.

Article 4. THE PRIZES

The ten Winners will each receive the following prize: one nominative free registration for ESC Acute CardioVascular Care Congress 2023. The winners will have the choice of an in-person or online registration. The free registration is not transferrable and is nominative. The prizes do not include travel and hosting costs.

Any false identity or email address provided will result in the Winner’s elimination. Similarly, the Organising Company reserves the right to take legal action, by all means necessary, against anyone attempting to abuse these Terms and Conditions.  

The prize may not give rise, on the part of the Winner, to any dispute of any kind, nor to the award of their equivalent value in money, nor to their replacement or exchange for any reason whatsoever.

In case of force majeure or if the circumstances so require, the Organising Company reserves the right to replace the prize won by a prize of equal or greater value.

Article 5. DESIGNATION OF THE WINNER

The Winners will be notified directly by e-mail within one month after the closing of the competition. The winners will need to confirm acceptance of their prize within 30 days of reception of the email. If any winner fails to confirm acceptance in the 30-day delay, he/she will lose his/her prize, which may be attributed to another Participant at Organising company’s discretion.

The Organising Company may not be held responsible for any misdirected e-mails.

Article 6. COLLECTION OF INFORMATION - DATA PROTECTION ACT

The information provided by Participants is subject to computerised processes to handle the organisation of the Quiz and delivery of the Prize

The data controller is the Organising Company.

For the organisation of the competition, the Organising Company will collect the following personal data: Name, email and contact details.

Personal data are collected and processed for the following purposes: organization and management of the Competition, information of the Winner, promotion of the Winners (including on social medias), grant of the free registrations for ESC Acute CardioVascular Care Congress 2023, management of claims in relation with the Competition.

Personal data that are collected and processed for the abovementioned purposes are retained for a period covering the organisation of the Competition and the management of the prize delivery. The Organising Company undertakes to delete all personal data that are no longer necessary, after the accomplishment of the purposes. Personal data of participants may be transferred to third party service providers of the Organising Company for the management of the Competition and prize delivery.

In accordance with the chapter 3 of the European Regulation 2016/679 with regards to data protection, participants have the right to request from Organising Company, access to and rectification or erasure of their personal data or restriction of processing concerning their data or to object to processing as well as the right to data portability. Please be aware that a proof of identity may be required during the process.

Participants have the right to lodge a complaint with a supervisory authority, and for information, the Organising Company has appointed a Data Protection Officer that can be reached at dpo@escardio.org.

ARTICLE 7. LIABILITY / FORCE-MAJEURE / EXTENSION / APPENDICES

The responsibility of the Organising Company is limited to the maximum overall amount of the prize involved.

The Organising Company cannot be held liable for any damage of any kind to a participant arising out of his/her participation in the Quiz.

The Organising Company cannot be responsible for any direct or indirect damage resulting from an interruption, a malfunction whatsoever, a suspension or the end of the Quiz, regardless of the reason.

The Organising Company cannot be held liable, in the event the Quiz operation is modified, shortened or cancelled due to a force majeure (as defined by French law) or to any event beyond its control.

In all cases, the Organising Company reserves the right to extend or reduce the participation period.

Additions, or in case of force majeure, modifications to these Terms and Conditions may occur during the Quiz. However, any changes in this respect will be notified beforehand by the Organising Company, using all appropriate means, in particular through its website.

The Organising Company reserves the right to use any recourse against, and in particular to prosecute anyone who makes use of cheating, fraud, falsification or disrupting the operations described herein, or, who may have attempted to do so.

Any Competition participant who is considered by the Organising Company to have disrupted the Competition operation in any of the aforementioned ways will immediately lose his/her rights to receive any winning prize, without being entitled to any claim.

Article 8. COMPLAINTS

Any dispute or claim must be made within 3 months of the end of the competition, by e-mail to the Organising Company to the following address: membership@escardio.org.

The email must specify the participant’s full details and the exact reason for the claim. Any other means of contestation or claim may not be considered.

Article 9. ACCEPTANCE OF THE RULES

Participation in the Competition implies full acceptance of these Terms and Conditions.

Any issue arising out of the interpretation or application of these Terms and Conditions shall be resolved at Organising Company’s discretion.

Requests by telephone regarding the interpretation or application of these Terms and Conditions, the mechanisms or the terms of the Competition or on the designation of the Winner will not be answered.

Article 10. AVAILABILITY OF THE RULES

Article 11. APPLICABLE LAW

The Competition, the Terms and Conditions and their interpretation are subject to the exclusive jurisdiction of the French courts and governed by French law.
